Silverbird Travel Plus Limited - Terms And Conditions


Accommodations:

Excellent hotel accommodations in line with the tariff and classification of the particular safari program on offer. All rooms are either twin-bedded rooms or Double bed with private bath or showers. Single rooms may be available with the payment of a supplement fee but not always be guaranteed. Some facilities have available double beds upon request. The Categories assigned to hotels reflect the opinion of Silverbird safaris.


Meals:

Three meals daily during the safari itinerary ( Breakfast, Lunch & Dinner); and Bed &Breakfast in any city stop over.


Taxes:

The tour program includes hotel taxes as imposed by city and county governments, entrance fees to National parks and Game Reserves, and airport taxes for intra-country flights. International airport taxes are not included.


Tour Price:

The prices quote are inclusive of all transportation as per the itinerary, full board accommodations as specified, local flights and local departure taxes where applicable, park entrance fees, permits where applicable, Tour Leader and driver’s/guide allowances, and third party insurance. All to be paid in US Dollars.


Not included in Quoted Tour price:

Cost of obtaining passports, visas, travel insurance, excess baggage charges, items of a personal nature such as drinks, laundry, communication (calls, faxes, emails, etc) international airport departure tax, deviations( any optional activities) from the tour itinerary, and gratuities and tips to tour leaders, drivers, rangers and trackers, and hotel waiters, and other personal expenses. All to be paid in US Dollars.


Ground Transport:

We operate both the 08 Seater Safari Minibus, or the 4 X 4  - 07 Seater Safari Land Cruiser. The type of transport utilized will be based on the specifications of the chosen itinerary, as well as the number of clients and the route taken. For reliable communications, our safari vehicles are equipped with both HF and VHF radios. Our Drivers and tour guides are fully trained and speak fluent English.


Flight Terms and Conditions:

  • Check – in is 02 hours on domestic flights and 03 hours on international flights prior to departure,
  • Each quote is only valid for the specified dates, and fares are guaranteed only on confirmed and ticketed bookings,
  • Prices may change without notice according to availability of all services quoted, foreign exchange fluctuations and airfare increases,
  • Unless specified, airport taxes as well as fuel & war surcharges are not included in the quote,
  • Changes and cancellations after ticket is issued are subject to airline cancellation and refund policy.
  • Please ensure you read and understand fully the respective Airline fare rules and conditions before you complete your ticketing transactions.

Travel Insurance:

Passenger protection plan (or any travel insurance), which also provides protection against lost damaged luggage, is highly recommended. Check with your travel agent or ask a Silverbird representative.


Mode of Payments:

We accept Credit Card payment and wire/swift remittances into our bank.

Clients will meet the cost of wire transfer which varies from Bank to Bank. For our purposes, Silverbird Travel will include a bank charge of USD 40 to be inidicated in the client invoice.

On Credit card payments our credit card secure payment Gateway charge 5% of the total invoice amount. The Invoice to the client will include the credit card charge.


Registration, Booking confirmation:

A deposit of 20% is requested at the time of booking. The balance or final payment is due 60 days prior to the departure. If a reservation is made within 30 days of departure, the entire amount must be made within 7 days of the booking confirmation. When booking your holiday with Silverbird Travel please quote the tour name, the intended date for arrival and departure, number of people traveling in your party, sleeping/ rooming arrangements and flight details, if known. This will ensure that our arrangements are concise and to your satisfaction. All payments as quoted and invoiced must be received in full before the start of the safari; and Silverbird travel Plus Limited will not provide the service unless full payment is received.  


Payment Mode:

All Quotations and Payments are in United States Dollars, unless otherwise specified, and shall be made by Credit Card or by Wire Transfer to our bank account - details to be provided on request. Silverbird Travel will receipt your money, and send you a copy of the receipt, thereby confirming your safari. All payments as quoted and invoiced must be received in full before the start of the safari; and Silverbird travel Plus Limited will not provide the service unless full payment is received.  


Cancellation:

Cancellations received by Silverbird 60 days or more prior to departure are subject to a 15% or $250 (whichever is higher) per person cancellation penalty. Generally, the following charges will apply from the date on which the company receives the written notification:

Cancellation received 60 days or more prior to the commencement of a tour – you will receive full refund less bank charges, and our booking fee equivalent to US dollar $250= or 15% ( whichever is higher) of the total refund value.

59 – 30 days----50 % refund.
29 – 15 days----25 % refund.
14 – 0 days -----Nil refund.

P.S Trip cancellation insurance is strongly recommended.


Tour Alteration:

Silverbird Travel reserves the right to alter any route or tour arrangement, to cancel the operation of any scheduled tour should the conditions necessitate. The right is also reserved to decline, to accept or to retain any member of a tour at any time. Should you fail to join a tour, then join it after departure, or leave prior to completion, there will be no refund of the unused sectors.


Transfer of Booking:

In the event you are unable to travel due to extra-ordinary circumstances, we may transfer your booking to another party provided the arrangements remain the same and if suppliers (airlines, hotel etc) are ready to accept the transfer.


Complaints:

If the client has a complaint/refund query about any aspect of his/her holiday it should be reported immediately to the Silverbird Travel tour leader while on safari. If the problem is not resolved to the client’s satisfaction, further complaint/refund query should be made by the client in writing to Silverbird Travel Plus Ltd not later than 30 days following completion of the holiday. Failure to do this, no claim may be brought against Silverbird Travel Plus Ltd.


Unused Services /Refunds:

There are no refunds for unused portions of the programme. It is understood and agreed that refunds will not be made to passengers who do not complete the tour for any reason whatsoever.


Arrangements:

Quoted tour rates include planning, handling and operational charges, based on the current rate of exchange and tariff as of December 2014. In the event of an increase in foreign exchange or tariff rates, rates are subject to revision.


Viewing Animals:

When it comes to game viewing, please be advised there are no guarantees. It is a privilege to see animals in their natural habitat. Take only a photograph; leave only a footprint. A gorilla permit guarantees you will trek gorillas to their location but does not guarantee that the gorillas be in plain sight.


Guaranteed Departures:

Silverbird guarantees departure of all group programs excepting only cases of force majeure. This includes any major world event that adversely affects international travel patterns and circumstances beyond Silverbird’s control.


Responsibility/ Liability:

Silverbird Travel plus Ltd d/b/a UNIGLOBE Silverbird travel, its employees, shareholders, directors (collectively “Silverbird”) does not own or operate any entity which is to or does provide goods or services for your trip, including, for example, lodging facilities, transportation companies, hotel facilities, airlines, including, without limitation, various entities which may be affiliated with Silverbird and/or which may utilize the Silverbird name, guides, food service providers, equipment suppliers, etc.

In addition, Silverbird is not responsible for any negligent or willful act or failure to act of any person or entity it does not own or control, nor for any act or inaction of any other third party not under its control.

Without limitation Silverbird is not liable for any direct, indirect consequential, or incidental damage, injury, death, loss, accident, delay, or irregularity of any kind which may be have occasioned by the reason of any act or omission beyond its control, including, without limitation any willful or negligent or failure to act on breach of contract of any third party such as airline, train, hotel, local ground handler or safari operator whether or not is affiliated with Silverbird or uses the Silverbird name, and/or restaurant which is, to, or does supply any goods or services for this trip.

Similarly, Silverbird is not responsible for any loss, damage, injury, death or inconvenience due to delay or changes of schedule, overbooking of accommodation, default of any third party, attacks by animals, sickness, the lack the appropriate medical care, evacuation to same, if necessary, weather, strikes, acts of God or government, acts of terrorism, force majeure, war, quarantine, criminal activity, or any other cause beyond its control.

Baggage is at “owner’s risk” throughout the tour unless insured. The right is reserved to alter or cancel itinerary, at Silverbird’s sole discretion, as maybe deemed necessary or advisable. Silverbird reserves the right to decline to retain any passenger on any of its tours if, in its sole discretion, it deems retaining any such passenger as being detrimental to the tour. Safari arrangements are based on rates which are only guaranteed by advance deposit payment.  In the absence of any advance deposit, there is no guarantee of availability and rates may vary accordingly.

All schedule airline flights are occasionally subject to overbooking or cancellation. If this occurs, Silverbird and/or its agents will use their best efforts to assist clients in boarding flights or finding alternative arrangement. Silverbird, however, cannot be held responsible for denied boarding, or any cost incurred.

Changes in the Responsibility clause can be made only in writing signed by an officer of Silverbird.

Any and all disputes concerning this contract, the brochure or your trip shall be resolved solely and exclusively by binding arbitration according to the current rules of the Kenya Arbitration Association in Nairobi, and any such arbitration, the substantive law of Kenya will apply.
